Questions people ask first

Do we have to be separated for 12 months?

Yes. A divorce needs at least twelve months of separation. You can be separated while still living under the same roof, but that needs extra evidence — mention it at intake so your lawyer can prepare it.

What does $899 include, and what is the court’s fee?

The $899 is our complete professional fee for preparing and filing your application — no hourly billing. The court charges its own filing fee separately: $1,170, or $390 if you hold an eligible concession card (for a joint application, both of you must hold one), as at 1 July 2026. That fee is paid to the court, not to us.

Can we apply together?

Yes, and it is usually the simplest way. With a joint application neither of you has to attend court, and there is no need to formally serve the other party.

We have children under 18 — can we still use this?

Not this fixed-fee option. Where there are children under 18, the court has to be satisfied that proper arrangements are in place for them, which is more than a simple divorce. We handle those matters separately — start your case here and we will guide you to the right path.

Does this divide our property or superannuation?

No. A divorce ends the marriage only — it does not touch property, super or debts, and a private agreement is not binding until a court seals it. To divide those you need consent orders, a separate binding court order. See our consent orders page.

Anywhere. Divorce is a federal process through the Federal Circuit and Family Court, so it does not matter which state or territory you are in.
