Mediation

In plain English

A process where a neutral person helps separating partners talk through their disputes and try to reach agreement without going to court.

What it means

Mediation is a confidential process in which an independent, neutral mediator helps separating couples negotiate parenting or financial issues and reach their own agreement. It is generally faster, cheaper and less stressful than litigation, and gives parties more control over the outcome. In parenting matters, mediation conducted by an accredited practitioner is known as family dispute resolution and can lead to a section 60I certificate. Agreements reached at mediation can be formalised in a parenting plan, consent orders, or a binding financial agreement to make them clearer or enforceable.

How it's used

Rather than going straight to court, they used mediation to agree on how to divide their property.
