"No Refunds" Signs

Also known as: no refunds policy, no refund sign

In plain English

Signs saying 'no refunds' or 'no returns' can't override your legal consumer rights.

What it means

Signs or policies stating 'No refunds', 'No returns', or 'No refunds on sale items' are unlawful under the Australian Consumer Law if they suggest consumer guarantee rights do not apply. Consumer guarantees cannot be excluded, and a consumer is always entitled to a remedy when goods fail to meet them. Businesses can refuse a refund for change of mind, but not when there is a genuine fault. The ACCC has taken action against retailers displaying misleading no-refund signs.

How it's used

Despite the 'No refunds' sign, the shop had to refund the faulty kettle because the consumer guarantee still applied.
