Cause of Action

In plain English

The legal basis for suing someone, made up of the facts that give you the right to a remedy.

What it means

A cause of action is the set of facts that gives a person a legally recognised right to seek a remedy from a court, such as breach of contract, negligence or misleading conduct. A claim must disclose a valid cause of action, or it can be struck out. Each cause of action has elements the plaintiff must prove. Causes of action are also subject to limitation periods, after which they can no longer be pursued.

How it's used

Their cause of action was breach of contract, because the supplier failed to deliver the goods on time.
